Mutual Recognition Program
Between
Saudi Standards, Metrology and Quality Organization (SASO)
AND
…………………………………………………
 
Referring to the strong relationship between Saudi Arabia
and.....………………………, and the importance of cooperation in the field of standardization activities especially conformity assessment procedures in order to facilitate, enhance and increase the trade between
both countries and complying with the (WTO-TBT) Agreement and to the previous contacts and arrangements by both parties, to sign a mutual recognition program on certificates of conformity and Quality Marks
issued by both organizations, both parties have agreed on the following:
 
First. Each Party shall provide the other with all its national standards and technical regulations or the equivalent internationally as much as both can, as a reference.
 
Second. Products bearing the Quality Mark:-
Both parties should consider the following:
 
1.      ……….. Products bearing (………..) Quality Mark in accordance with Saudi standards or international standards if Saudi standards for that product do not exist or any other
standards (SASO) will determine, shall be allowed to enter the Kingdom of Saudi Arabia without any Technical
barriers.
 
2.      Saudi products bearing (SASO) quality mark in accordance with ……….. Standards or international standards if ………… Standards for that product do not exist or any other standards upon the request from (……….) shall be
allowed to enter ………. without any Technical barriers.
 
3.      Each Party shall provide the other with a list of firms authorized to use the Quality mark and their products, providing authenticated copies of valid certificates, while the other Party shall authenticate the certificate and provide the authorized entities with a copy of this certificate to be taken in consideration, and allow entry without any technical barriers. The exporter can be provided with the certificate of
conformity upon his request, for any consignment.
 
Third. Products not bearing the Quality Mark:-
1.         (SASO or ………….) will provide any exporter with the required Certificate of Conformity upon his request, while (SASO or ……….) has the right to sign a similar (MRP)
with other accredited Bodies in the other parties' country.
 
2.      Each Party shall follow proper procedures to ensure the conformity of the commodities to standards and technical regulations required by the importing Party, taking in consideration the related ISO/IEC Guide.
 
3.      Each Party shall issue the required certificate of conformity if clause (2) of (Third) are fulfilled and notify the other Party by facsimile or e-mail or any other electronic program as
soon as the certificate issuing procedure is complete and provide a copy of that certificate, to the other party.
 
4.      The certificate issuing entity shall deliver the certificate to the exporter to attach it with the exported consignment, and to be appended with an official stamp to avoid forgery.
 
5.      Each importing Party shall notify authorities responsible – in their country – of the issuance of the certificate after authentication to be taken in consideration to allow entry.
 
6.      Both parties shall establish a software programme for that purpose containing all necessary information about the certificates of conformity issued by both parties or by the
accredited Bodies by (……….) or by (SASO) allowing personnel representing the surveillance authorities
responsible for entry in both countries, a limited access to this software for verification purposes of the certificates
issued by (SASO) or (………..).
 
7.      (…………) should not issue any certificates of conformity or Quality Mark for the purpose of exporting to the Kingdom of Saudi Arabia for the products containing pork or pork
products or alcohol and inform the accredited certification bodies' about it.
 
8.      Both parties shall develop awareness programmers coordinating with the authorities responsible for entry in
both countries.
 
9.      Saudi products and (…………) certified products under this mutual recognition shall be subjected to the prevailing Laws and Regulations of both countries.
 
Forth. Crude oil, food products, Medicines and Medical Devices are not
covered in this Program.
 
Fifth. Each Party shall notify all entities responsible for export and import activities in both countries, i.e. Ministry of commerce and industry, customs, chambers of commerce and others to inform the exporters of this program to be taken in consideration to establish a fluent trade without any technical barriers at the borders entries.
 
Sixth. This program shall be effective on the date of its signature, and will be valid for (12) twelve months, renewable for another similar period automatically unless either party notifies the other of its demand of termination by three months Notice.
 
Seventh. Any dispute arising out of the interpretation of this program, shall be settled in a friendly manner, and if the dispute continues, the two parties shall arrange a meeting to solve this dispute, as much as they can with full satisfaction of both parties.
